KissBank Limited (“KBL”) strongly believes in your rights to privacy, especially when using our Website and our Service. This is a legal document describing how KBL will use and handle data that we collect from you. This Privacy Policy should be read in conjunction with KBL’s Terms and Conditions and Acceptable Use Policy. These three documents govern the way we collect, process, use and store data you supply and your responsibilities when you register as an Account Holder or visit our Website.

1. INFORMATION WE MAY COLLECT FROM YOU

i. Your Email Address
One of the most essential pieces of information we will require from you is your email address.

KBL will not send you any ‘spam’ emails, but we may, from time to time, need to send to you important information via email to ensure that you receive the best possible and most satisfying service from us. The most likely reason we will send you an email is to notify you, unless you have opted out of this facility, that you have received a Kiss. You may also from time to time receive emails updating you on new features of our Service and information about your Account. However, it is our intention that you learn such information primarily through logging into your Account on our Website. We set out below a full list of emails you may receive directly from us:

a. A validation email: this will allow you to verify that you manage the email account registered to your name and allow your Account to be activated.
b. Welcome email: once registered, you will receive a welcome email delivering you some vital information about how our Website and our Service operate.
c. Service emails: which will inform you of any alteration to any of our Services.
d. Kisses received emails: whenever you receive a new Kiss, and have not opted out of this facility, you will be notified via email.
e. Report emails: which will be sent to you if for any reason any of your activity, Content or material on our Website or used in respect of our Service is reported to us by another Account Holder or visitor to our Website.
f. Contact emails: if you contact us through email, you may receive a reply via email.
In the “My Account” section of our Website you may be able to alter the settings related to the type, nature and frequency of emails you receive. We will only send you email notification concerning important matters. Once registered, your email address will not be visible or accessible to any other Account Holder or visitor to our Website. Your email address can be changed and managed through “My Account.”

Non Account Holders may receive emails from us if:

a. They have been sent a Kiss through a direct contact who already has their email address.
b. They receive an invitation to join our Service.
c. They have been forwarded an invitation to join our Service via a database connected to us.

Any issues relating to email addresses can be raised with us through the Contact Us  section of our Website.

ii. Registration Data
When you register for an Account with KBL, it is compulsory to provide certain information. Some of this information will be available for other Account Holders to view, such as:

– Name
– Location
– Sex
– Biography (this is optional upon registration, but once filled in, will be compulsory to display)

Other information will be displayed only if you provide it and choose to allow us to display it:

– Relationship status
– Occupation
– A picture of yourself

You are able to change this information at any time, but on the basis that as stated in our Terms and Conditions, your information must be honest and accurate at all times.

iii. Third Party Websites
Where you choose to use a link to a third party website not connected to us we will not have access to, hold or retain any data you supply to that third party website. The way that third party website collects, processes, uses and stores any data you provide, and your responsibilities when you provide such data and use that website are governed by the Terms and Conditions, Privacy Policy, Acceptable Use Policy and other policies of that website. We accept no responsibility whatsoever for the consequences of you using such a website.

2. COOKIES

“Cookies” will generally be necessary to enable Account Holders to access and use our Website and our Service in the easiest, quickest and most satisfying way. We use them:

a. To store Account Holders’ log-in details, so that relevant information is displayed when logging in. You can however disable the option “Remember Your Password”.
b. To receive the best possible user experience by means of a temporary “session” cookie.

Once the session is terminated or once the Account Holder has chosen to log off, the temporary cookie ceases to function.

iii. Enable us to discuss with you stories that you submit to us for potential publication on the Website.
iv. Enable us to inform you of matters concerning our Website and our Service that you are entitled to be informed of under your agreements with us and/or that we believe will enhance your user experience.

KBL stores your information on secure servers which comply with industry best practice in terms of back up facilities; security measures to prevent unauthorised access to your data; and facilities to ensure that your data is retained securely for as long as you choose it to be retained and for as long as we are required to retain it by law. Our servers are located in the EEA, but we retain the right, subject to informing you, to utilise servers located anywhere in the world for commercial, security or other reasons, subject to ensuring that  there is no impairment in the level of security applied to the storage of your data.

We apply several over-riding conditions in respect of sharing and using certain information.

a. We will only provide any of your personal details to a third party under the circumstances disclosed in and incorporated in this Privacy Policy.
b. The information you provide to allow others to identify you will be shared with other Account Holders and with visitors to our Website. As stated above, some of this information will be compulsory, and some will be optional.
c. Advertising. Our Service may include interactive advertising for other businesses. We may use, and provide to third parties, anonymous demographic data provided by Account Holders to enable advertisers to target this advertising more appropriately.
d. We may on certain occasion share data provided from you directly or collected about you with companies who are within KBL’s corporate group. If this does occur, this will only be done so for the purposes described in this Privacy Policy.

4. YOUR OBLIGATION TO MAINTAIN SECURITY

KBL applies stringent security controls and measures to protect our Website and our Service and to ensure the security and integrity of information submitted by our Account Holders. This means that access to this database will be for internal use only. Nonetheless, every Account Holder has individual responsibilities:

a. to ensure no unauthorised access to your profile and to your Account.
b. to log off of from your  Account after every session and/or to ensure that no-one else has access to your Account when you are  not using it.
c. whilst logged on to your Account, you must not allow any other person to use our Service from your machine
d. Your password must be kept completely confidential at all times.

5. ACCOUNT HOLDERS’ RIGHTS

As an Account Holder you have the right:

i. To prevent us from processing the information you have supplied to us for any purpose other than specified in our Terms and Conditions, Privacy Policy and Acceptable Use Policy. If you have any suspicion or concern that we are using your data for any other purpose we encourage you to raise this concern with us via the Contact Us facility.
ii. To request us to provide you with details of all the personal data and information we hold about you. By law, we are permitted to charge you a modest fee for providing this service.
iii. To delete your Account. You need to be aware that if you delete your account:
a. you will be removed from all KissBank Indexes. Your Profile will no longer be visible and your name and details can no longer be searched. You will not be able to receive or send Kisses to anyone. You will lose access to all information connected to Kisses you have sent or received, including any messages attached to them. However, any Kisses you have already sent will be retained by the people you sent them to.
b. Even though your Profile and your Account will be deleted, we retain the right to archive and store certain information for a necessary period of time for legal reasons.
c. The Content supplied by you as an Account Holder may have been copied and/or stored by another Account Holder and/or visitor to our Website. We can accept no responsibility for how this Content is used.

6. LEGAL DISCLOSURE

We reserve the right at all times to disclose and communicate certain Account Holder’s information to a third party who desires, or is entitled to, the disclosure of it. This includes circumstances where we are obliged to comply with a legal obligation or we are compelled to disclose information by a judgement of a court of competent jurisdiction.

7. RETENTION OF DATA

Under our Terms and Conditions, we reserve the right to retain your personal data for any necessary period for the purposes which have been outlined or as is required by law. After this date, your data will be deleted.
